Обсуждение стандартов риэлтерской деятельности
У мене стандарт від АСНУ викликає лише почуття невдоволення. Зокрема в наступних пунктах:
1. У разі, коли під назвою «стандарт» є Постанова,
саме Кабмін визначає організацію, котра видає цей сертифікат. По суті -
це ліцензування ріелтерської діяльності
2. Видача сертифікатів суперечить законодавчо визначеному переліку видів діяльності, які підлягають ліцензуванню.
3. Не визначено терміну «Державний реєстр
суб'єктів ріелтерської діяльності» . Не визначено, який орган веде
Реєстр, а також хто має доступ до нього. Та і навіщо він потрібен
взагалі саме в статусі «державного»?
4. За умов обов'язковості виконання Постанови, акт
прийому-передачі ріелтерської послуги стає знаряддям недобросовісних
клієнтів, котрі свідомо не бажають оплатити надані ріелтором послуги.
Результат роботи ріелтора має нематеріальний характер. Отже, якщо акт
не підписано, то ріелтор у суді ні за яких обставинне доведе факт
надання послуги, виконання своєї роботи. Результат - не отримання
гонорару.
5. Сьогодні ріелтерською діяльністю можна
займатися вільно, не будучи суб'єктом ріелтерської діяльності
Підзаконній акт (Постанова) не може встановлювати ліцензовані види
діяльності.
6. Постанова робить можливим ліцензування КОЖНОГО виду діяльності ріелтера.
7. У підсумку, чесні ріелтери будуть змушені йти «вчитися» та
отримувати свідоцтво -сертифікати, а ринок захоплять «чорні маклери»,
яким не потрібні ці «папірці». Невже це покращить ситуацію на ринку?
Звичайно ні! Ця Постанова на роки назад відкидає нас від цивілізованого
ринку нерухомості, до якого ми поступово, але невпинно, рухаємося

Наприклад, п. 2.4
До ріелторських послуг відносять:
-послуги, які надаються замовнику при здійсненні нім операцій з власним нерухомим майном, у тому числі здавання в оренду власного нерухопмого майна, здавання в оренду власної житлової та нежитлової нерухомості, земельних ділянок;
-посередницькі послуги з купівлі, продажу, оренди та оцінювання нерухомого майна.

Як розуміти?
п. 1.1 Особливості та підстави здійснення ріелторської діяльності, у тому числі навчання, сертифікація, стандартизація на засадах саморегулювання, з певніх її видів та напрямків визначаються окремими національними стандартами.
п. 1.4 Ріелтор - фахівець, з нерухомості, який має освіту не нижче рівня молодшого спеціаліста, склав кваліфікаційний іспит та одержав кваліфікаційне свідоцтво ріелтора.
Всегда принятие какого-то документа вызывает у ряда людей негативные эмоции и высказывания.
Но в обсуждаемом стандарте есть самые главные преимущества:
Во-первых, введение этого стандарта позволит поднять уровень оказания услуг – ведь для получения Сертификата необходимо будет регулярно сдавать экзамен и подтверждать квалификацию.
Во-вторых, с рынка придется уйти дилетантам и мошенникам, что сделает его более прозрачным, безопасным, цивилизованным.
Во-третьих, риэлтор будет работать совершенно легально и в правовом поле. Его профессия будет внесена во все государственные реестры, у него будут полные права в рамках совершения своей работы. Таким образом профессия риэлтора будет признана на государственном уровне.
Артем, Вы глубоко ошибаетесь, этот "стандарт" дает только дополнительный, причем на ровном месте, источник доходов для "чиновничья". Для этих паразитов на теле народа и все, больше он ничего не дает.
Мне просто прийдется купить диплом за 300 баксов и заплатить за курсы, заплатить за экзамен, заплатить за корочку и еще заплатить за че-то. Или оформить все это на кого - нибудь имеющего уже все эти бумажки, так работает половина строителей и мы должны работать также?! Все отлично знают, что это принесло в строительный рынок - самый корумпированный рынок Украины.
Введение подобных правил игры, приведет только к созданию еще одной вертикали поборов предпринимателей. Существующая или вернее формирующаяся у нас в стране система подготовки специалистов, а также система добровольной сертификации, функционирование нескольких(!!!), а не одной, общественных организаций риэлторов - это нормальный цивилизованный путь развития рынка услуг.
Я понимаю, что в этом виде рынок риэлторских услуг не приносит денег власть имущим и некоторым лидерам риэлторских организаций, просто по ночам неспится от желания стать главным по приему налички и выдаче дипломов, сертификатов и т.д. А рассказы о благе потребителя - это только рассказы, да Вы все об этом и сами знаете...
Во-вторых, с рынка придется уйти дилетантам и мошенникам, что сделает его более прозрачным, безопасным, цивилизованным.
Артем, даже при железной власти СССР, на рынке услуг царствовали "черный маклеры", даже под угрозой расстрела и ареста.
Вы думаете, что принятие какого-то стандарта остановит мошенников в нынешнее время??
Пользу от этого стандарта не увидят не потребители наших услуг, ни мы сами:((

Там, где присутствует государственное регулирование - отсутствует рынок, а присутствие чиновников - произвол и взяточничество. Реальный выход - саморегулирование, общественные организации и добровольность!!!
АСНУ уже не первый год пытается скрутить рога всем риэлтерам!!!
Первый был Каплий, который хотел собрать с каждого АН по 40 000 баксов, второй - Бондаренко, который хотел всех риэлтеров загнать на обучение.
И вот тебе на, новая оказия...!!!!
Очередная чиновничья кормушка... По моему глубокому разумению, "стандарты от АСНУ" - это ни что иное, как замаскированное лицензирование риэлтерской деятельности. Как мы - риэлтеры, то раньше жили и работали без этих "стандартов"? Вспомним что такое поборы, взятки, курсы - шмурсы... Ничего хорошего для нас - риэлтеров это "чудо" не принесет, рАвно как и для потребителя наших услуг. Мошенники и были, и будут... Плюс ко всему эти "стандарты" делают возможным стандартизацию КАЖДОГО вида риэлт. деятельности по отдельности...
Резюме: зачем НАМ все ЭТО???

Это трудный вопрос. Правильно работают все риэлтерские компании, которые работают официально (не скрываются по подворотням), имеют договора, способны защитить клиента юридически и защититься сами. Обычно это компании, которые присутствуют на рынке не один год. То что их названия и договора разные, это не проблема. Их объединяет одно - они предоставляют качественную риэлтерскую услугу. И об этом говорят их коллеги и благодарные клиенты.
Думаю, что стандарты риэлтерской деятельности принять сейчас реальнее чем любой Закон Украины.
Я працюю лише 7 місяців,є офіс,договора(зразки надала власниця АН,яка вже працює три роки),однак вже АН, які працють не один рік,гарно відзиваються про мою роботу.А також є клієнти,які приводять своїх знайомих.Я думаю,що "росту" і працюю правильно.А як на Вашу думку?
